TENNESSEE COURT OF CRIMINAL APPEALS UPHOLDS RULING IN CUMBERLAND COUNTY SEXUAL BATTERY AND DOMESTIC ASSAULT CASE
The Tennessee Court of Criminal Appeals has upheld the rulings of Judge Gary McKenzie in a Cumberland County sexual battery and domestic assault case.
Brian Keith Medley, through his attorney Jeffrey Vires, had argued that the evidence presented at trial was insufficient to support his conviction and that the sentence imposed by McKenzie was excessive.
In a 12-page opinion filed this month, the appeals court disagreed.
“When viewed in a light most favorable to the State, the evidence plainly is sufficient to support the Defendant’s convictions for domestic assault and sexual battery,” wrote Judge Tom Greenholtz. “The evidence establishes that the Defendant intentionally caused bodily injury to (the victim.)”
As to the sentence Medley received, prosecutors argued on appeal that “the trial court did not abuse its discretion by sentencing the Defendant to the statutory maximum sentence of four years.”
