LAWSUIT FILED BY SON ON BEHALF OF MEIGS COUNTY WOMAN WHO DIED ON VALENTINE’S DAY WHILE BEING TRANSPORTED BY NEW DEPUTY

MEIGS COUNTY, Tenn. (WATE) — The son of a Meigs County woman who died after a deputy’s vehicle crashed into a river has filed a wrongful death lawsuit seeking millions in damages, WTVC reported Monday.

Tabitha Smith was arrested by Deputy RJ Leonard on February 14 shortly before both were reported missing. Investigators later determined that Leonard had driven off a boat ramp into the Tennessee River.

The patrol vehicle was pulled from the river the next day. Smith’s body was found still handcuffed in the backseat. Leonard’s body was recovered from the river hours later.

Leonard had recently graduated from the police academy and had started with the sheriff’s office just two months ago.

According to a copy of the lawsuit obtained by WTVC, the lawsuit claims wrongful death, gross negligence, deprivation of liberty interest and bodily integrity, battery and assault, loss of consortium, and two violations of Tennessee code. It names Leonard and the Meigs County government as defendants.

It alleges that the county failed to properly train Leonard to adequately know his area of patrol and failed to train him to refrain from using his cell phone while transporting an arrestee.

It also contends that the location where the car crashed into the water has a history of similar incidents. The lawsuit requests a trial by jury and $10 million in damages.
