CROSSVILLE WOMAN KICKS OFFICER IN ABDOMEN WHILE VIOLENTLY RESISTING ARREST

On 09/25/2022 Crossville police observed a white Dodge Journey traveling West on Hwy 70 East. The vehicle had an expired tag since April 2022 so they initiated a traffic stop. Officers made contact with the driver identified to be Sarah Yu who rolled both windows down simultaneously, and they observed that while retrieving her documents and driver’s license she had very slow movements and an alcoholic odor was emitting from the vehicle.  Officers observed a bottle in the middle console with a pink liquid  in it and asked her what it was and she stated

that it was alcohol. She had very red watery eyes and slow, slurred speech. Ms. Yu stated that she had consumed at least two alcoholic beverages. The officer being suspicious of her driving under the influence asked for Ms. Yu to step out of the vehicle. Once she was asked, she gave a blank stare while continuing to stay seated in the vehicle. The officer asked her several more times while she continued to stay seated. After the fourth time she finally exited from the vehicle, walking unsteady on her feet.

The officer asked Ms. Yu if she would consent to Standardized Field Sobriety Tests and she stated that she would, but she did not understand why it was necessary due to the fact that she had been pulled over only for her expired tags.  The officer advised her that it was because she had admitted to consuming alcohol so she agreed she would undergo the tests. The officer observed that she stared with a blank look in her eyes during one of the tests and stopped in the middle of it. The officer asked her why she stopped mid test and she again started to argue that she didn’t think she should be undergoing the tests just for an expired registration. It was explained again about the alcohol consumption. Ms. Yu then stated that she was aware that she shouldn’t be driving and that she just needed to get home to her kids. She stated that she had left Bootleggers and that she had probably consumed more than two alcoholic beverages. She continued stating that she would not perform the tests. Ms. Yu was then put into handcuffs with double locks. While attempting to get her into the passenger side patrol unit, she actively resisted by pushing and shoving her body weight from side to side and pulling her arms away from officers. When they attempted to put her inside of the patrol unit, she continued to jump out and wedge herself at the edge of the unit so that  they were unable to put her in the unit. Officers attempted to get her legs into the unit and she continued to kick them back out.  An officer went in from the units driver’s side and grabbed Ms. Yu by her arms and pulled her into the unit. She was then safely placed into the unit and her safety belt placed across her. She attempted to take her safety belt off after she was placed into custody

At this point she was read read her Implied Consent rights. After the first time, Ms. Yu stated that she did not understand so officers read her the rights again, and Ms. Yu continued to argue stating she did not understand and continued to want them read.

An officer transported her to the Cumberland County Justice Center to intake and was granted a Search Warrant by a Judicial Commissioner for two vials of blood from Ms. Yu. Once back in intake  despite the Search Warrant, she continued to state that she would not consent to giving blood. An officer placed Ms. Yu in handcuffs and double locked them both. Ms. Yu asked if the officer was going to make the handcuffs tighter, because they weren’t tight enough. The officer tightened the left handcuff up and checked both to make sure that one finger could be placed between both handcuffs. She then continued to state that they both needed to be tighter. Two officers walked Ms. Yu to the door where the sally port was located, once at the door she started to actively resist. She shoved herself back and started to actively push her body weight around in attempt to not go to the patrol unit.  The officers then pulled her arms up higher so that she would have a more difficult time resisting, until at the patrol unit. While placing her in the patrol unit she started to actively push her self off and wedge herself in the corner where the door was located. Ms. Yu again had to be placed inside the unit. Once she was placed, she shoved and kicked at the center abdomen area of one of the officers, forcing him to stumble back several feet.

Ms. Yu was transported to the Cumberland Medical Center for the blood draw. Two vials of whole blood were extracted from Ms. Yu  who uttered several times that she was aware that she should not have been driving, but that she would have made it home anyway.
