ALERT CALLER STOPS ASSAULT IN PROGRESS OF CROSSVILLE WOMAN
On February 12, 2023 at approximately 10:30 p.m., city units were dispatched to the area of the SK Mart where a domestic assault was being observed. The caller stated that she observed a male subject exhibiting very erratic behavior in the Wal-Mart parking lot. The subject was pacing around a vehicle and going back and forth to the passenger and driver side. At some point it was observed there was a younger female subject in the passenger side of the vehicle. The
male subject started tugging on the female and throwing property out of the vehicle. The vehicle left the Wal-Mart parking lot traveling southbound on N. Main St. and the caller observed that once the vehicle entered the construction zone, the passenger door started to open up. The vehicle then pulled into the SK Mart. She observed The male subject approach the passenger side of the vehicle and the female exited from the vehicle from the driver side. Both subjects started to travel on foot away from the vehicle in a way that would be described as argumentative.
A city officer arrived on the scene shortly after being dispatched. The vehicle was located and the passenger was open and it was found unoccupied. The officer observed several yards away a male and female arguing. Once they observed the police patrol unit in the area, the female started to run towards the officer and the man started to walk swiftly in the opposite direction. The officer made contact with the female first, and she began to state that the man had hurt her and he was trying to get away. The officer told her to stay where she was and that another officer would be with her in just a moment. The officer was able to make contact with the male subject in the field near SK Mart and detained him at that time. The man was identified as David Brothers. He stated that he had not struck the female. He stated that he continued to tell her to get out of the vehicle and that she would not. He further stated once the vehicle made a stop in the parking lot, she willingly removed herself from the vehicle. He later stated that she attempted to jump from the vehicle due to the fact he threw out used aluminum foil with narcotic residue and a syringe from the window. The officer observed that Mr. Brothers’ hands had scratches across the top of the hands as well as a purple bruise. The markings appeared to be several days old. While searching him he located two cell phone devices on Mr. Brothers.
Another officer arrived at the scene and made contact with the female who stated that once Mr. Brothers’ abruptly parked the vehicle at SK Mart, he came to the passenger door and started to grab her by her feet and legs in an attempt to physically remove her from the vehicle. She held onto the steering wheel, when he then got on top of her and started to cover her mouth and grabbed her by the throat. She stated that she could breath and did not feel as if she had been strangulated. She was able to free herself from his grip and exited from the driver side door. He followed her to the area where the first officer observed and located them. At the end of the investigation, the female stated that she was unable to locate her cell phone device but that the phone did not have minutes and was only used with wifi. The female was transported to a safe place.
The first officer was able to confirm Mr. Brothers to be the primary aggressor of a Domestic Assault and arrested and transported Mr. Brothers to the Cumberland County Justice Center where he was charged and served a warrant for Domestic Assault and Bond Conditions.
