$1MILLION FALSE ARREST SUIT SETTLED BY CUMBERLAND COUNTY

Cumberland County has settled a lawsuit brought by Jim Howe of Crossville. Back in November 2013, Howe was arrested for disorderly conduct after he attempted to pick up his children on foot from South Cumberland Elementary School. Howe left his vehicle on foot to get the children, but school personnel would not allow the children to leave unless a special form was filled out which Howe allegedly refused to do. Words were exchanged between Howe and the School Resource Officer which led to Howe’s arrest. The whole encounter was recorded on video and posted the internet. WATCH VIDEO HERE.   Howe filed a $1 million lawsuit against the County in Sept. 2014 for false arrest and violation of his First Amendment rights. According to reports, the suit was settled for $100,000.  However, it was  determined that Howe fell short of being deprived of his constitutional rights and that when a child attends public school, both the children and their parents are bound to the rules and sanctions of the schools. Since the incident,  the school has widened pickup lanes and a policy change allowing for children to be picked up on foot after buses and other pickups are made.
