SPIRIT BROADBAND STILL NOT PAYING BILL TO CUMBERLAND COUNTY

We were wondering how things were going in the County’s efforts in recovering hundreds of thousands of dollars owed by Spirit Broadband for past franchise fees.  Last we heard the County and Spirit had reached an agreement for Spirit to pay the fees in installments.   Here’s the answer we got from the County legal department:

 

Crossville’s News First inquired today on the status of the first $50,000 payment due from Spirit Broadband to the County which would be about three weeks past due. Cumberland County Attorney Randal Boston was contacted to determine the status of the payment. Boston stated that on the date the payment was due he attempted to speak with Spirit ‘s Attorney Daniel Rader IV of Moore, Rader, Fitzpatrick and York of Cookeville. Several attempts Boston said have been made to ascertain the status of the agreed upon payment but Mr. Rader will not respond to the Counties requests for information. C. Douglas Fields and Boston brought suit against Spirit Broadband to recover franchise fees owed to the County and the matter was settled with the assistance of former Circuit CourtJudge John Turnbull in a a settlement conference.  Spirit has failed to honor its agreement.  Mayor Carey has “led the charge” in pursuing this case according to Boston and was very diligent on the terms of the agreement.  It is as simple as Spirit and it’s counsel continues to ignore agreements made with the County and their counsel.
